An account balance, a guarantee demand and a claim against mortgaged property require different analysis. We reconcile documents and payments, examine the scope of undertakings and identify available defences or negotiated options. Any restructuring proposal should address interest, security, release conditions and the consequences of a further default.
Regulation and the financing structure
Banking and finance advice depends on the institution, product and current Bangladesh Bank directions. Finance companies require consideration of the Finance Company Act 2023 rather than relying on the repealed 1993 framework. Cross-border borrowing and remittances also require a review of the applicable permissions and documentary conditions.
Documents to prepare
Begin with a short non-confidential outline, parties’ names and urgent dates. After the initial checks, we agree which of the following records are needed and how to share them.
- Facility letters, amendments, account statements and repayment records
- Mortgage, charge, guarantee and security documents
- Demand notices, classification correspondence and court papers
- A schedule of disputed charges, payments and relevant assets
Common questions
Frequently asked questions
How is a defaulted bank loan recovered?
The lender, facility, security and governing law determine the available process, including the Money Loan Court framework where applicable. We review notices, accounts and security before advising on proceedings, negotiation or recovery. No forum guarantees a quick recovery.
What should I do about a dishonoured cheque?
Keep the cheque, return memo, transaction records, notices and evidence of service. Notice, payment and filing requirements are date-sensitive and depend on the applicable law. Obtain advice promptly rather than assume a single deadline covers every stage.
Who regulates banks and finance companies?
Bangladesh Bank is the central banking regulator. Banks and finance companies operate under distinct legislation and regulatory directions, including the Bank Companies Act and the Finance Company Act 2023 as applicable. We check the institution and relevant product before advising.
Can a borrower or guarantor challenge recovery?
Available objections depend on the documents, accounting, procedure and claim. Defending a suit, disputing liability and challenging a regulatory decision are different routes. We assess jurisdiction and any restrictions before recommending a defence or application.
What makes a security package effective?
The asset, owner, instrument, execution, registration, priority and enforcement terms all matter. Mortgages, charges, pledges and guarantees are not interchangeable. We review the whole security package and identify further steps required under the applicable law.
