A case built around the agreement

Before a notice is served, we check the parties, the scope of the clause, applicable preconditions and the proposed relief. We distinguish the seat from the hearing venue and institution. A clear issues list and proportionate evidence plan help control the work required for written submissions and hearings.

Protecting the practical value of an award

Winning an award and recovering money are separate questions. We consider assets, security, interim protection and the law of the enforcement forum. Settlement terms should address payment, release, costs and enforceability. Foreign proceedings are coordinated with appropriately authorised counsel when the instruction requires them.

Documents to prepare

Begin with a short non-confidential outline, parties’ names and urgent dates. After the initial checks, we agree which of the following records are needed and how to share them.

  • Contract, arbitration clause and incorporated rules
  • Notices, proof of service and the procedural timetable
  • Claims, responses, witness records and expert material
  • Award or court order and details of assets relevant to enforcement

Common questions

Frequently asked questions

What law governs arbitration in Bangladesh?

The Arbitration Act 2001 is central to Bangladesh arbitration law. Its application to the agreement, seat, court support and enforcement must be considered with the facts and any agreed institutional rules. Not every foreign element produces the same legal consequences.

Will a court enforce an arbitration agreement?

A referral depends on a valid and applicable arbitration agreement, the dispute within its scope and compliance with procedural requirements. Timing matters. We review the court papers and clause promptly before advising on jurisdiction or participation.

Can a foreign arbitral award be enforced in Bangladesh?

Recognition and enforcement may be available under the applicable statutory and convention framework, subject to conditions and grounds of refusal. We review the award, agreement, service records and assets. Enforcement is not automatic and should be assessed separately from the merits.

Can an award be challenged on its merits?

A challenge is subject to limited statutory grounds, the competent court and strict procedural requirements. It is not an ordinary opportunity to rehear the dispute. Preserve the award, date of receipt and procedural record and seek advice promptly.

Why do the seat and institution matter?

The seat identifies the legal place of arbitration and normally the supervisory court. An institution administers proceedings under its rules when chosen. The hearing venue may be elsewhere. These choices affect court support, procedure, costs and enforcement planning.
