Common questions

Frequently asked questions

Who can instruct a Bangladeshi law expert?

We consider enquiries from overseas firms, chambers, in-house teams and other appropriate instructing parties. Acceptance depends on expertise, conflicts, availability and the receiving forum’s requirements. The client relationship and reporting responsibilities should be agreed clearly.

Is an expert an advocate for the paying party?

An expert opinion must be independent and confined to the relevant expertise. Under CPR Part 35 in England and Wales, the expert’s duty to help the court overrides obligations to the instructing or paying party. Other forums have their own applicable requirements.

What can the report address?

The agreed questions may concern applicable Bangladeshi legislation, case law, procedure or legal effect. The expert identifies assumptions, sources and limits. Matters outside the agreed expertise or requiring factual or technical evidence should be addressed by the appropriate witness or professional.

Is court permission required?

The receiving forum’s procedure determines permission, scope, format and admissibility. For English civil proceedings, CPR Part 35 includes a court-permission requirement. We review the directions and instructing counsel’s requirements before agreeing a report.

Can you respond to another expert or give oral evidence?

Supplementary reports, responses, joint discussions and oral evidence may be considered subject to expertise, independence, availability and the forum’s directions. These tasks should be included in, or added to, the written scope and timetable.
