Ownership before registration or licensing

A brand, software product or commissioned design can involve several contributors. We review employment and commissioning terms, assignments and licences to identify who owns which rights and what use is permitted. A registration application should be consistent with the underlying ownership and the goods or services actually concerned.

Evidence-led enforcement and commercial use

Before sending a notice or applying for relief, preserve dated examples of the disputed use, relevant registrations and the commercial context. We distinguish infringement from passing off, contractual breach and other claims. Licence scope, territory, quality control, royalties and exit arrangements should also be clear before a right is commercialised.

Documents to prepare

Begin with a short non-confidential outline, parties’ names and urgent dates. After the initial checks, we agree which of the following records are needed and how to share them.

  • Registration certificates, applications and renewal records
  • Original works, design files and evidence of creation or first use
  • Employment, assignment, licence and commissioning agreements
  • Dated infringement evidence, sales records and relevant correspondence

Common questions

Frequently asked questions

How do I register a trademark?

The process ordinarily involves a search, application, examination and the applicable publication and opposition stages. The mark, owner and goods or services must be identified accurately. Registration is not guaranteed, and objections require a considered response.

How long do patents, copyright and trademarks last?

Duration, renewal, fees and the starting date depend on the right, work or registration and current law. Do not apply a single period to every asset. We review the records and identify filing, renewal and expiry issues.

What can I do about infringement or counterfeiting?

Available remedies depend on the right, ownership, evidence, conduct and forum. Options may include a carefully framed notice, negotiated resolution or appropriate proceedings. Preserve evidence first and avoid unsupported public allegations about the alleged infringer.

Should I register a copyright work?

Copyright protection and the evidential role of registration must be assessed under the applicable law. Registration does not replace proof of authorship, ownership or a valid assignment. We review the work and documents before recommending the appropriate protective steps.

Does Bangladesh protection extend worldwide?

Intellectual property rights are territorial. Foreign protection and enforcement depend on the destination and applicable procedures or treaties. We coordinate appropriately authorised local advice where required rather than assume a Bangladesh registration protects every market.
